Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “Customer”) and Risky Terms (“Risky Terms”, “we”, “us”) governing your access to and use of the Risky Terms website, scanning engine, monitoring service, AI rewrite tools, dashboards, data feeds, and APIs (collectively, the “Service”). By creating an account, checking the “I agree” box at signup or checkout, accessing the Service, or paying for a plan, you agree to these Terms, our Privacy Policy, and our Security Statement.

Risky Terms scans publicly available web pages you submit, identifies language we have classified as creating potential errors-and-omissions (“E&O”) exposure for insurance agencies, and offers suggested rewrites and monitoring. We also offer paid data products (e.g. term-prevalence aggregates, per-site findings feeds, REST APIs and webhooks).

The Service is an informational tool only. It is not legal advice, regulatory advice, underwriting advice, or a substitute for review by qualified counsel, a compliance officer, or your E&O carrier. You are solely responsible for any decisions you make based on the Service.

You must be at least 18 years old and authorized to bind the entity you represent. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized access.

• Paid plans are billed monthly in advance in U.S. Dollars via our payment processor (Stripe).
• Subscriptions auto-renew until canceled. Cancel anytime from the billing portal; access continues until the end of the current period.
• Except where required by law, fees are non-refundable, including for partial periods, unused features, or unused volume.
• You are responsible for all applicable taxes, duties, and assessments.
• We may change pricing or plan limits with at least 30 days’ notice; changes apply on the next renewal.
• Failed payments may result in suspension after a reasonable retry period.

The 7-day trial grants temporary access to your scan results. After the trial expires, results are locked behind a paywall until you upgrade. We may modify or end free offerings at any time.

You agree not to:

• Submit URLs you do not own or are not authorized to scan, or that violate any third party’s rights or terms.
• Use the Service to scrape, crawl, or extract data from sites at a rate or volume that violates those sites’ terms or robots directives.
• Reverse-engineer, decompile, or attempt to derive the source of the Service, except as permitted by law.
• Resell, sublicense, or redistribute Service output, data feeds, or API responses except as expressly permitted by your plan.
• Use the Service to build a competing product, train a competing model, or benchmark for publication without our written consent.
• Interfere with the Service, attempt to exceed rate limits, or probe for vulnerabilities outside an authorized program.

You retain ownership of URLs, sites, configuration, and any text you submit for AI rewriting (“Customer Content”). You grant Risky Terms a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and analyze Customer Content as needed to operate, secure, support, and improve the Service.

You represent that you have all rights necessary to grant this license and that your Customer Content and use of the Service do not violate any law or third-party right.

We compute aggregated, de-identified statistics from scans across all customers (for example, prevalence of specific terms or risk categories across the broader market). These aggregates do not identify you, your customers, or any specific site, and we may use, publish, license, and sell them as part of our data products and research, including after termination. Rewrites and other AI-generated output are produced by automated models and may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing all AI output before publishing or relying on it. Do not submit sensitive personal information, health information, or non-public personal information of consumers into AI rewrite inputs.

API access is metered per plan. We may throttle, suspend, or revoke keys that exceed limits or appear abusive. Data feeds and API output are licensed for your internal business use within the scope of your plan; redistribution requires our written consent or an enterprise agreement.

The Service relies on third parties including hosting/CDN, authentication and database (Supabase), payment processing (Stripe), and transactional email providers. Their terms and privacy policies also apply to your interactions with them.

Each party will protect the other’s non-public information with at least reasonable care, use it only to perform under these Terms, and not disclose it except to personnel and contractors bound by confidentiality obligations.

The Service, including the scanner, term taxonomy, scoring models, dashboards, documentation, and all improvements, is owned by Risky Terms and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms and your plan.

If you send us suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

You may stop using the Service at any time. We may suspend or terminate your access for breach, non-payment, fraud, abuse, or risk to the Service or other users. On termination, your right to use the Service ends and we may delete Customer Content after a reasonable retention period.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and quiet enjoyment. We do not warrant that the service will be uninterrupted, secure, or error-free, or that findings, scores, or rewrites are accurate, complete, or legally sufficient.

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or related to the service will not exceed the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim or (b) one hundred U.S. dollars (US$100).

You will defend, indemnify, and hold harmless Risky Terms and its affiliates, officers, employees, and agents from any claim or demand, including reasonable attorneys’ fees, arising out of your Customer Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Delaware. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
